Terms of Use

This Terms of Use Agreement ("Agreement") has been concluded between ufkas Teknoloji A.Ş. ("ufkas" or "Company") and users utilizing platform services ("User" or "Users").

This Agreement regulates the terms of use of the platform, products and services offered by ufkas and the rights and obligations of the parties.

• "Platform": Web site, mobile applications, APIs and other digital services belonging to ufkas
• "Services": All products, services and solutions offered via the Platform
• "User": Real or legal persons registering to the Platform or benefiting from the services
• "Content": All kinds of data, information and material on the Platform

The following conditions apply for Platform membership:

• Being over 18 years old
• Providing real and up-to-date information
• Opening an account for a single real person/institution
• Ensuring account security

Users accept the following obligations:

• Complying with Platform rules and policies
• Acting in accordance with laws and general morality rules
• Respecting the rights of others
• Ensuring account security
• Fulfilling payment obligations on time

The rights and obligations of ufkas are as follows:

• Providing Platform services uninterruptedly and securely
• Protecting User data
• Solving technical problems
• Making necessary updates
• Providing User support

All intellectual property rights on the Platform belong to ufkas:

• Software and technology infrastructure
• Brand, logo and trade names
• Design and visual elements
• Content and documentation
• Patents and other industrial rights

Regarding the processing and protection of personal data:

• Compliance with PDPA and relevant legislation
• Data security measures
• Data processing purposes and methods
• User rights and application methods

Payment terms for paid services:

• Pricing and payment methods
• Invoice issuance and submission
• Tax and legal obligations
• Refund and cancellation conditions

Platform service level commitments:

• Planned maintenance works
• Technical problems and resolution times
• Service interruption notifications
• Compensation and remedy conditions

Activities prohibited on the Platform:

• Sharing illegal and harmful content
• Spam and abuse
• Actions threatening system security
• Use of fake accounts and identities

Liability limitations of ufkas:

• Indirect and incidental damages
• Third party services
• Force majeure
• Problems caused by user errors

Contract duration and termination conditions:

• Indefinite contract
• Termination reasons and procedure
• Post-termination obligations
• Account closure and data deletion

In the resolution of disputes:

• Republic of Turkey laws apply
• Istanbul Courts and Enforcement Offices are authorized
• Mediation and arbitration options

The following situations are considered force majeure:

• Natural disasters and states of emergency
• War, terror and civil unrest
• Cyber attacks and security breaches
• Legal regulations and restrictions

In contract amendments:

• Amendment notification methods
• Amendment acceptance process
• Right of rejection and consequences

Assignment and transfer of the contract:

• User assignment prohibition
• ufkas's assignment rights
• Company mergers and acquisitions

In case any provision of the contract is invalid:

• Other provisions remain valid
• Legal regulation applies instead of invalid provision

In notifications between parties:

• Electronic notification methods
• Notification addresses
• Notification periods
